No order will be accepted by Matest without prior written approval. All orders must be placed in writing. Each sales contract is fully subject to the following conditions, and no variation or alteration of these conditions shall be made unless expressly agreed in writing between the parties.
All prices for goods are understood ex-works Matest and are exclusive of VAT, packaging, transport, insurance, installation, and other costs, unless expressly specified otherwise. All prices and terms quoted by Matest may be modified without notice. Matest reserves the right to impose a minimum order fee and to correct any accidental errors or omissions in quotations and invoices.
Payment terms are specified in the Matest sales contract as well as the maximum credit value, and are shown on the sales invoice. Payment begins with the notification of goods being ready and with the invoice date.
Failure to pay by the due date will immediately cancel any further supply
to the customer.
Unpaid amounts will accrue late interest not lower
than the current rates and all additional costs resulting from non-payment.
Goods remain the property of Matest until full payment of the purchase price.
We reserve the right at any time to request payment security before proceeding
with the delivery of any order.
Delivery time is given purely as an indication. Therefore, any liability
for delivery delays caused by any reason is excluded.
Shipments
are always made on behalf of the customer with the agreed system or the
one deemed most suitable, with all risks and expenses borne by the customer.
These conditions also apply to sending goods to the Matest site for repairs
or inspections and subsequent return. Matest is not responsible for any
loss or damage of goods in transit.
The Buyer is obliged to collect the goods within 4 working days from the notification of readiness. After this period, Matest reserves the right to charge the customer the costs incurred: €150.00 for handling packages and documents, plus €10.00 per day for each stored package.
Unless otherwise specified, the warranty is valid for 12 months from the
invoice date.
The warranty covers free repair or replacement of any
product manufactured by Matest, exclusively for material or manufacturing
defects, provided they are returned freight prepaid within the warranty period.
If the goods cannot be returned or require an on-site inspection to decide whether the repair falls within warranty terms, all expenses for the visit by Matest personnel are the responsibility of the customer.
For goods not manufactured by Matest, the customer will receive the warranty
provided by the manufacturer.
The warranty on Matest compression and
bending machines is extended to 30 months from the invoice date. This
condition has been in effect since December 2010. Warranty expires if
payment terms are not respected, if damage is caused by improper or
non-compliant use, tampering, or repair attempts by unauthorized personnel.
All components subject to inevitable wear (seals, belts, diamond crowns, etc.)
are excluded from the warranty.
Matest offers a complete range of products to allow the customer to have a full materials testing laboratory. Minor items supplied come from other manufacturers and are not labeled Matest, but are still covered by Matest Warranty.
Not all accessories and auxiliary items can be provided by Matest, nor can every item be labeled with the actual catalog number. Therefore, it is recommended that an experienced materials testing person check the supplied equipment.
The Customer is obliged to inspect the goods upon delivery or collection, as applicable. Any complaints regarding quantity and type of material supplied must be notified to Matest within 8 days of receipt of the goods by registered letter.
Do not return any equipment to Matest without prior authorization. After our authorization, return with prepaid transport.
Changes to ongoing orders will only be accepted after written confirmation
by Matest.
In case of order cancellations by the customer for any
reason, Matest reserves the right to charge the client for costs incurred
for preparation, storage, and any packing and shipping costs.
If requested by the customer or deemed necessary by Matest, we will insure
the transport of goods by adding the costs to the invoice.
Matest
shall not be held responsible for not insuring goods if no written request
was made by the Customer.
These services are not included in the sale prices.
Relevant operating
instructions will be provided with the equipment, allowing laboratory
technicians to acquire adequate skills to install the equipment.
Testing and assembly times and methods will be managed by Matest. The
Customer undertakes to complete, accept, and comply with the conditions
set on the appropriate form.
Product photos and technical specifications in catalogs are the most up-to-date at the time of publication. However, considering the company's policy of continuous product development, Matest reserves the right to modify, improve, and delete models without notice.
The contract shall be governed and interpreted in accordance with Italian law, and all disputes shall be subject to the jurisdiction of Italian courts.
